Requesting Information

Effective January 1, 2012, the Freedom of Information and Protection of Privacy Act (FIPPA) applies to hospitals and aims to enhance transparency and public accountability.

FIPPA is composed of two components of equal weight:

Access: to provide the public a right of access to a diverse range of hospital information
Privacy: to protect individuals’ personal information collected and used by hospitals

The legislation applies to all information held by Baycrest Hospital from January 1, 2007 onward and governs how certain types of information is collected, used or disclosed. The act applies to any records in the hospital’s custody or control. Upon request, Baycrest Hospital will provide records subject to limited exceptions described in the act. There are many ways to access Baycrest information. Submitting an access request under FIPPA may be a helpful alternative if you cannot retrieve your desired records through the following avenues first:

  • Explore our website
  • Consider requesting the information informally. You can contact the department or area of the hospital that you think may have the information you are looking for. You will be assisted with your request and told whether the information can be provided to you informally, or whether you will have to submit a freedom of information request.

Accessing information under FIPPA

If you cannot find the information that you seek on our website or by requesting the information informally, you can make a freedom of information request by submitting an Access/Correction Request Form (PDF) or by writing a letter to Baycrest’s Freedom of Information co-ordinator.

Your request must include:

  • A $5 cheque or money order payable to Baycrest
  • Enough information to allow an experienced staff member to locate the records. Be as a specific as possible when you are describing the information that you would like to access. If you are completing an access request form and require more space, continue your description on a separate sheet of paper
  • Remember to include your authorization form if you are requesting personal information on behalf of another individual

If your request is vague or very broad, the FOI co-ordinator will contact you for clarification. When writing your request, try to provide a specific description of the information you require and if possible, note the dates or time frame of the requested records. A clearly defined request with a narrow scope will assist Baycrest to search, locate and retrieve the record so we can respond promptly.

We will make every reasonable effort to respond to your request within 30 calendar days from the date the Baycrest receives your request. However, there may be specific circumstances set out in regulation where Baycrest is permitted to extend the time limit beyond the 30 days. The FOI co-ordinator will contact you if additional fees are required to administer a complicated or large request. The FOI co-ordinator will also notify you in writing whether your requested records will be released in full, only partially disclosed or completely withheld. If you are not satisfied with Baycrest’s response to your freedom of information request, you have 30 days from the date of our letter to request a review by the Ontario Information and Privacy Commissioner.

Fees

Application fee: $5  to be paid when you submit your request

Photocopying: $0.20 per page

CDs: $10 per disc

Record preparation: $7.50 per 15 minutes spent by any person

If, after processing your request, Baycrest determines that you will be granted access to the requested records, we will mail a notice of our decision and a detailed breakdown of all applicable fees. After receiving your payment, Baycrest will then disclose all releasable records.

If your fees total over $100, Baycrest may require that you pay a deposit equal to 50 per cent of the estimate before taking any further steps to respond to your request.

There are many provisions in FIPPA that limit what information Baycrest Hospital can disclose. If such exemptions or exclusions apply, the requested record may be completely withheld or only partially disclosed. When responding to all access requests, Baycrest Hospital will issue a decision letter which will explain, in detail, what provisions of FIPPA were applied and give reasons for any nondisclosure of information.

The Freedom of Information and Protection of Privacy Act does not apply to the following type of records:

  • Personal Health Information
  • Records related to the operations of the Baycrest Foundation
  • Records related to a physician’s personal practice
  • Records related to charitable donations made to Baycrest
  • Records related to certain labour relations, employment and placement matters
  • Records related to certain physician and dentist appointment and privileging matters
  • Certain records associated with research (including clinical trials)
  • Certain records related to teaching materials

 

Under FIPPA, Baycrest may refuse to disclose the following types of records:

  •  Third party information
  • Another individual’s personal information
  • Certain records related to advice or recommendations
  • Certain records that could prejudice the financial or other specified interests of Baycrest
  • Information subject to solicitor-client privilege
  • Information that could be reasonably expected to endanger the health or safety or an individual
  • Information already publicly available or soon to be published

 

If you are not satisfied with Baycrest’s response to your Freedom of Information Request, you have 30 days from the date of our decision letter to request a review by the Ontario Information and Privacy Commissioner:
